Man pleads guilty to drug possession

DEER LODGE — A guilty plea to drug possession is among the various cases handled in Deer Lodge district court this week.

Highlights follow:

  • Brandon W. Swarengin pleaded guilty to felony possession of dangerous drugs and admitted he has a chemical dependency problem.

    According to court records, on March 31, 2008, Swarengin allegedly ingested oxycodone and propoxyphene, without lawful authority, in sufficient quantities that he overdosed and was taken to Powell County Memorial Hospital for treatment.

    Judge Ray Dayton sentenced Swarengin to a three-year commitment with the Department of Corrections with the recommendation of pre-release following completion of chemical dependency treatment. Judge Dayton said the sentence would be punishment and a deterrent, but has an emphasis on rehabilitation.

    The sentence is to run concurrent with the revoked sentence Swarengin is serving from Gallatin County. He is to pay $110 in court fees and was given credit for 63 days served. He was remanded to the custody of Powell County Law Enforcement.

  • Lucinda Lopez pleaded guilty to the charge of attempting to transfer illegal articles to a felon. According to court records, Lopez allegedly attempted to deliver tobacco and related products to an inmate at Montana State Prison on Feb. 2, 2008. Judge Dayton ordered a pre-sentence investigation. She is free on bond.

  • Julian Johnson and Justin Louis Dore pleaded not guilty to felony aggravated assault.

    According to court records, Johnson, Dore and James Aaron Whittington were arrested at approximately 2:30 a.m. April 27 after an altercation with Matthew Schillo during which Schillo was severely beaten resulting in serious face and head injuries, including a broken jaw. Whittington entered a not guilty plea in court last week.

    If found to be guilty, the men could each face a maximum of 20 years in prison and a $50,000 fine. Johnson and Dore were released on $5,000 bonds.
